Court Rejects Munyes’ Bid for Turkana Vote Recount, Scrutiny​

A court in Lodwar on Friday dismissed John Munyes’s application for recount and scrutiny of votes cast the Turkana governor election. The former senator, who was recently nominated to Cabinet, is challenging Governor Josphat Nanok’s election on August 8, 2017. Judge Justice Stephen Riech said the application was filed after the court had concluded hearing submissions by parties.

He said Munyes ought to have made the application for a recount during the pre-trial of the petition. The court Nanok’s lawyer Philip Nyachoti’s argument that the application for scrutiny, a recount of votes was made in bad faith. Riech held that the order for scrutiny ought to have been included in the main petition so as to allow the court to direct for preservation of election materials.

He said that from the submission of the governor’s lawyer , it was clear that the pleadings of the petitioner asking for a recount, audit and tallying of votes could not be granted . “The petitioner had only wanted the court to make a determination on the election process, violence, bribery and misuse of county resources,” Nyachoti argued.He told the court that the allegations were not proven by Munyes’ witnesses and agents adding that the ex-Senator sought an order for a by-election.
